Terms of Service

Status: DRAFT — not yet published. Written 2026-07-07 as part of pre-launch checklist item #11, updated 2026-07-19 with the operating entity (Entryze AB) and the enforced minimum age, and updated 2026-07-21 for the product rename from PTAI to CrestAI (name only — no change to what the service does, who operates it, or how data is processed). This is engineering-drafted text meant to accurately describe what the app actually does. It has not been reviewed by a lawyer and must not be treated as final or legally binding until it has been. Remaining [TBD]s: §5 (payment terms — deliberately deferred until a provider/pricing model is chosen), and lawyer review of §9/§11.

1. Who these terms are with

These Terms of Service ("Terms") are a contract between you and Entryze AB, a Swedish aktiebolag (org.nr 559545-3167, registered at Mölndalsvägen 87 f, 412 84 Göteborg, Sweden) ("we", "us", "our"), the operator of CrestAI. By creating an account or using CrestAI, you agree to these Terms and to our Privacy Policy.

2. What CrestAI is

CrestAI is a personal training journal and AI coach: you log workouts, nutrition, and bodyweight, and an AI coach (built on Google's Gemini models) gives you training suggestions, analysis, and coaching conversation based on that data.

3. Not medical advice

CrestAI's AI coach and all content in the app are for informational and educational purposes only. Nothing in CrestAI is medical advice, and the AI coach is not a doctor, dietitian, physiotherapist, or other licensed healthcare professional.

  • Always consult a qualified healthcare professional before starting any new training or nutrition program, especially if you have an existing injury, medical condition, or are pregnant.
  • Stop any exercise that causes pain and seek medical attention if needed.
  • The AI coach's suggestions are generated from patterns in your logged data and general training principles — they are not personalized medical guidance and can be wrong. Use your own judgment.
  • If you are experiencing a medical emergency, contact emergency services, not the app.

Acceptance tracking built 2026-07-14 — every user must explicitly check a box acknowledging this disclaimer (separate from ToS/Privacy Policy acceptance) before reaching the app (LegalAcceptanceGuard, design in docs/legal-acceptance-design.md). A version bump to this document re-prompts existing users. This still does not make the text itself final — the [TBD] placeholders below still need a lawyer review before this is legally binding.

4. Your account

  • You must provide accurate information and keep your login credentials secure.
  • You must be at least 13 years old to use CrestAI.
  • You are responsible for all activity under your account.
  • We may suspend or terminate accounts that violate these Terms or misuse the service (e.g. attempting to abuse the AI features, scraping, or attacking the service).

5. Subscriptions and payment

[Section pending — payment provider and pricing model not yet chosen; checklist items #3–7 are deliberately being worked last, once the rest of the app is launch-ready. This section must be written once that decision is made, and will need to cover:]

  • What the subscription includes, price, and billing interval
  • Free trial terms, if any
  • How to cancel, and what happens to your data and access after cancellation
  • Refund policy
  • Automatic renewal disclosure (required under Swedish/EU consumer law)
  • The 14-day right of withdrawal for EU consumers, and the required in-app withdrawal mechanism — Sweden's distansavtalslagen amendments effective 19 June 2026 require a working withdrawal button in the app itself, not just policy text (see checklist item #23)

6. Acceptable use

You agree not to:

  • Use CrestAI for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the service, other users' data, or our infrastructure
  • Reverse-engineer, scrape, or use automated means to extract data from the service beyond your own account (your own data export is always available via the Profile page)
  • Use the AI coach to generate content unrelated to fitness/nutrition coaching in a way that abuses the service

7. Your content

You retain ownership of the training, nutrition, and other data you enter into CrestAI. You grant us the license needed to store, process, and display it back to you, and to send it to our AI sub-processor (Google Gemini) solely to generate your coaching responses — see the Privacy Policy for details on how your data is used and who processes it.

8. Third-party data sources

Some nutrition data shown in the app comes from Open Food Facts, licensed under the Open Database License — a public, community-maintained database. We do not guarantee the accuracy of third-party nutrition data; always check packaging if precision matters (e.g. for a medical dietary requirement).

9. Disclaimers and limitation of liability

[TBD — needs lawyer review; jurisdiction-appropriate boilerplate below as a starting point.]

  • CrestAI is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee the AI coach's suggestions are accurate, complete, or suitable for your specific circumstances (see §3, Not medical advice).
  • To the maximum extent permitted by law, our liability for any claim arising from your use of CrestAI is limited to the amount you paid us in the 12 months before the claim arose.
  • Nothing in these Terms excludes liability that cannot be excluded under Swedish or EU consumer protection law (e.g. for death, personal injury caused by negligence, or fraud).

10. Changes to the service or these Terms

We may update CrestAI's features and these Terms over time. We will notify active users of material changes before they take effect and update the "Last updated" date above.

11. Governing law

[TBD — confirm with legal review, but Swedish law is the expected default given the operator is based in Sweden.] These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles. As an EU consumer, you retain any mandatory consumer-protection rights under the law of your own country of residence that cannot be waived by choice of law.
